Asylum
An asylum seeker is a person who leaves their country of residence, enters another country, and makes in that other country a formal application for the right of asylum according to the Universal Declaration of Human Rights Article 14.
Removal proceedings
Removal proceedings are a legal process that determines if a noncitizen can remain in the United States. They are typically held in Immigration Court by an immigration judge
When do removal proceedings begin?
- When the government believes someone doesn’t have valid immigration status
- When someone violates the terms of their visa or other temporary status
- When someone commits immigration fraud, certain crimes, or national security violations.
How can you challenge removal proceedings?
- File a motion to reopen to introduce new evidence
- File a motion to reconsider to reexamine the decision due to errors of law or fact
Citizenship & Naturalization
Naturalization is the process by which a non-citizen can become a citizen after meeting specific legal requirements, such as residency, language proficiency, and passing a citizenship test. So, while naturalization leads to citizenship, it is the process of acquiring it rather than the status itself.
